Ousted Lagos Speaker Obasa Challenges Impeachment in Court

Former Speaker of the Lagos State House of Assembly, Mudashiru Obasa, has filed a lawsuit against the Assembly and its new Speaker, Mojisola Meranda, contesting the legality of his removal. The case, yet to be assigned to a judge, was brought before the Lagos State High Court in Ikeja.

In the suit dated February 12, 2025, Obasa, through his lawyer, Chief Afolabi Fashanu (SAN), argued that his impeachment on January 13, 2025, by 36 lawmakers while the Assembly was on recess was unlawful. He claimed the decision was made in his absence while he was out of the country, violating constitutional provisions and legislative procedures.

Seeking multiple legal reliefs, Obasa requested an expedited hearing and a court order mandating the defendants to respond within seven days. He also urged that his legal team be given only three days to file replies on points of law.

The former speaker’s case is built on nine legal arguments centered on the interpretation of the 1999 Constitution (as amended) and the Lagos State House of Assembly’s Rules and Standing Orders. He maintains that the impeachment was unconstitutional, as the Speaker neither convened the session nor delegated authority to do so.

Citing public interest, Obasa pressed for a swift ruling to determine the legitimacy of the House’s leadership and prevent legislative disruptions. He also emphasized the court’s authority to grant an expedited hearing.

Obasa was removed on January 13 by over two-thirds of the 40-member Assembly over alleged misconduct and other offences. His deputy, Mojisola Meranda, was immediately sworn in, making history as Lagos State’s first female Speaker.

Upon returning on January 25, Obasa was received by supporters at his residence in GRA, Ikeja. Speaking on the controversy, he claimed due process was not followed in his impeachment. He alleged that security agents, led by the Lagos State Commissioner of Police, facilitated the move, storming both the Assembly complex and his residences in Agege and Ikeja with over 200 officers, locking his family indoors. He also denied allegations of financial misappropriation.

No date has been set for the hearing of the case.
