According to reports, the decision was handed down on Friday by Justice Isa Hamma Dashen of the Federal High Court in Yenagoa.
The presiding court concluded that the former President is qualified to run for President in 2023.
Jonathan’s right to run for president again, he added, cannot be thwarted by any retroactive legislation.
Recall that Jonathan was elected President of Nigeria in 2010 after his predecessor, late Umaru Yar’Adua, died.
While vying for re-election in 2015, a court ruled that Jonathan was entitled to run because his first inauguration was to complete Yar’Adua’s term.
Nevertheless, in 2018, President Muhammadu Buhari approved the fourth amendment to the 1999 Constitution, which prohibits Vice Presidents from serving more than one full term after their principals.
Andy Solomon and Idibiye Abraham, on the other hand, have filed an origination summons seeking a court order indicating that Jonathan is unaffected by the fourth modification.
The plaintiffs sought an accelerated hearing through a move ex parte, which Justice Isa Dashen granted to allow Jonathan to run in the APC primary on Sunday, May 30.
Having been granted the permission to contest the APC presidential primary, Jonathan will slug it out with the likes of the APC National Leader, Bola Tinubu; Vice-President Yemi Osinbajo; Senate President Ahmad Lawan; the immediate past Minister of Transportation, Rotimi Amaechi; Governor Dave Umahi, Governor Ben Ayade, Senate President Ahmad Lawan; Governor Badaru Abubakar, Senator Ibikunle Amosun, Senator Ajayi Boroffice and among others should he eventually join the race.
