President Donald Trump, two of his sons and the Trump Organization filed a lawsuit Thursday against the Internal Revenue Service and the U.S. Department of the Treasury, alleging the government failed to protect their confidential tax information during Trump’s first term.
The suit, filed in federal court in Florida, names Trump, Donald Trump Jr. and Eric Trump as plaintiffs and seeks $10 billion in damages.
According to the complaint, the agencies breached their “duty to safeguard and protect” the plaintiffs’ tax returns and related information, allowing unauthorized access and public disclosure. The plaintiffs allege the leak caused reputational and financial harm, public embarrassment, damage to business reputations, and harm to Trump’s and his family’s public standing.
The lawsuit stems from a 2019–2020 breach in which Charles Littlejohn, a former IRS contractor, illegally obtained and leaked tax information belonging to Trump and thousands of wealthy Americans to two news organizations. Littlejohn pleaded guilty in 2023 and was sentenced to five years in prison.
At his sentencing in 2024, a federal judge described Littlejohn’s actions as “an attack on our constitutional democracy.”
The complaint argues that despite Littlejohn’s criminal conduct, the IRS and Treasury bear responsibility for failing to prevent the breach and protect highly sensitive taxpayer information.
