Supreme Court Reinstates Senator Anyanwu as PDP National Secretary

The Supreme Court has overturned the judgments of both the Court of Appeal and the Federal High Court, which had previously sacked Senator Samuel Anyanwu as the National Secretary of the People’s Democratic Party (PDP).

In its ruling, a five-member panel of the apex court held that issues concerning party leadership are internal affairs of a political party and therefore not justiciable in court.

Delivering the lead judgment, Justice Jamilu Tukur struck out the October 2024 ruling of the trial court and set aside the Court of Appeal’s December decision that upheld Anyanwu’s removal. Instead, the Supreme Court affirmed the minority judgment of Justice Ekanem, who had ruled that the lower court lacked jurisdiction over the case.

The court further ruled that the plaintiff, Aniagu Emmanuel, had no legal standing to file the case, as he failed to prove how Anyanwu’s appointment personally affected him.

With this decision, Senator Anyanwu remains the PDP’s National Secretary, securing a major victory for his faction within the party.
