Detained IPOB leader, Nnamdi Kanu, has filed a ₦50 billion lawsuit against the Nigerian Medical Association (NMA), accusing the association of submitting a forged and misleading medical report in his ongoing trial at the Federal High Court in Abuja.
In the fresh suit marked CV/4584/25, filed on November 12 before the Abuja High Court, Kanu is also asking the court to compel the NMA to conduct an independent and comprehensive medical examination on him by specialists not connected to the defendants. The suit was filed by his lawyer, Maxwell Opara.
The defendants listed include the NMA; its President, Dr Bala Audi; and members of the medical panel that issued the disputed report: Dr Benjamin Egbon; Prof. Emem Abraham; Dr Ajibare Adeola; Dr Temitope Farombi; Dr Sunday Owolade; Dr Mustapha Salihu; Dr Yarima Yusuf; Dr Nwosu Ekeoma; and Dr Benjamin Olowojebutu.
Kanu accused the defendants of negligence, malice, gross professional misconduct, and failure to carry out the medical examination ordered by the court. According to him, the panel neither visited, interviewed, nor examined him, despite a direct order from the Federal High Court to assess his health after the prosecution challenged the authenticity of an earlier medical report.
He alleged that the panel nevertheless submitted a report dated September 23, which he described as “false,” “fabricated,” and produced without any form of interaction with him. Kanu further claimed the defendants “conspired to pervert the course of justice,” resulting in avoidable pain, reputational harm, and deterioration of his health.
Kanu, who is standing trial in Suit No: FHC/ABJ/CR/383/2015, said his health worsened significantly in detention. His legal team had submitted a medical report requesting bail or proper medical treatment, but after the prosecution queried its authenticity, the court directed the NMA to conduct an independent assessment—an order he insists was ignored.
Kanu is asking the court to declare the medical report:
· False and fabricated.
· Issued in violation of a valid court order and medical ethics.
· A breach of his constitutional rights to fair hearing and dignity.
He is also seeking:
· A withdrawal and public retraction of the controversial report.
· A perpetual injunction against relying on false or unverified medical reports about him.
· A fresh, independent medical examination by qualified specialists.
· ₦50 billion in general damages for health injury, reputational damage, emotional distress, and rights violations.
· ₦500 million in exemplary damages for alleged malicious conduct.
· ₦15 million as the cost of the suit.
