Pro-Trump Allies Circulate Draft Executive Order Seeking National Emergency Over Unproven 2020 Election Claims

A group of attorneys and political allies aligned with President Donald Trump is circulating a draft executive order that would declare a national emergency based on alleged Chinese interference in the 2020 election — claims for which there is no verified evidence — according to multiple sources familiar with the effort.

The 17-page draft, which sources say Trump has reviewed, proposes sweeping changes to federal election procedures ahead of the upcoming midterm elections. Among its provisions are mandatory voter identification requirements, a nationwide ban on mail-in ballots, and a requirement that ballots be counted by hand rather than by electronic voting machines.

Supporters of the draft say they expect its contents to be incorporated into a broader executive order that could be issued in the near future, though it remains unclear whether the president intends to move forward with it.

Florida attorney Peter Ticktin, who confirmed to ABC News that he has been in contact with the White House about the proposal, said timing is critical with primary elections approaching. Ticktin also represents former Colorado county clerk Tina Peters, who was convicted and imprisoned for breaching voting equipment.

According to Ticktin, the proposed emergency declaration would give the president authority to restrict or eliminate electronic voting machines and mail-in ballots, which proponents argue could be vulnerable to foreign interference.

“The most important provision, if you ask me, is the hand counting,” Ticktin said. “Get rid of the machines. That’s what we need to do right away.”

It is not yet clear whether the draft order has formal support within the administration or whether it will ultimately be issued.
