Femi Falana (SAN) has filed contempt proceedings against Oyo State Governor Seyi Makinde for allegedly disobeying a subsisting Oyo State High Court judgment on the control of motor parks in the state.
Falana submitted Form 48 against the governor, the Attorney General and Commissioner for Justice, and the Commissioner for Public Infrastructure, Works and Transportation, alleging they flouted the court’s orders in Suit No: M/246/2020.
The applicants in the suit include Alhaji Abideen Olajide, Alhaji Lekan Aleshinloye, Alhaji Isiaka Ajetunmobi, Alhaji Kasali Lawal, and the National Union of Road Transport Workers (NURTW).
A court document dated February 11, 2026, warns: “Take notice that unless you obey the directions contained in this judgment/order, you will be guilty of contempt of court and will be committed to prison.”
Justice M. A. Adegbola, in a February 17, 2021 judgment, granted declarative reliefs to the applicants, issuing a perpetual injunction restraining respondents and their agents from interfering with motor park management or collecting dues from parks or commercial drivers.
The court set aside park manager appointments made on February 17, 2020, ruling the action ultra vires and unconstitutional under the 1999 Constitution. Justice Adegbola emphasized that park management and appointment of managers are the exclusive duties of Local Government Councils, as outlined in Section 7 (5), Paragraph 1(e) of the Fourth Schedule of the Constitution. The court concluded that the current state-appointed management and rate collection are illegal and contrary to constitutional provisions.
