Grand Jury Declines to Indict Six Democratic Lawmakers Over Video on Refusing Illegal Orders

The U.S. Attorney’s Office for the District of Columbia did not secure an indictment against six Democratic members of Congress over a video they posted last fall advising service members that they are obligated to refuse unlawful orders, according to multiple sources familiar with the case.

The lawmakers — Elissa Slotkin, Mark Kelly, Maggie Goodlander, Jason Crow, Chrissy Houlahan, and Chris DeLuzio — shared a social media video stating that, as former members of the military or intelligence community, they believe service members have a duty to refuse illegal directives.

A grand jury declined to return an indictment, issuing what is known as a “no true bill.” Such outcomes are rare after prosecutors formally present a case.

In response, Kelly accused President Donald Trump and his allies of political retaliation. “This is an outrageous abuse of power,” Kelly wrote on X, saying the effort to pursue charges stemmed from speech officials disagreed with. He added that Americans should not be intimidated from speaking out.

Slotkin similarly criticized the investigation and singled out District of Columbia U.S. Attorney Jeanine Pirro, alleging the move was politically motivated. She said a grand jury of citizens ultimately determined the case should not proceed and expressed hope that the matter was now closed.

The decision means no charges will be filed against the six lawmakers in connection with the video.
