A former violinist and tour crew member for Will Smith has filed a lawsuit against the actor and his touring company, alleging wrongful termination, retaliation, and sexual harassment — claims that Smith’s attorney has denied.
Brian King Joseph, who toured with Smith in 2025, filed the complaint Tuesday in Los Angeles County Superior Court. Joseph alleges he was fired after raising concerns about workplace safety during the tour.
According to the lawsuit, Joseph said he reported to Smith and tour management that someone had unlawfully entered his hotel room in Las Vegas and left behind several items, including a handwritten note, wipes, a beer bottle, a red backpack, an earring, hospital discharge paperwork for an unknown individual, and a bottle of HIV medication bearing another person’s name.
The handwritten note allegedly read: “Brian, I’ll be back no later [sic] 5:30, just us,” followed by a drawn heart and the name “Stone F,” the complaint states.
Joseph said he reported the incident to hotel staff, contacted a local non-emergency police line, and notified Smith’s representatives. He told them he feared the unidentified individual might return to his room and attempt to engage in sexual activity.
The lawsuit claims that within days of reporting the incident, Joseph was terminated from the tour and accused of fabricating the allegations. Another violinist was subsequently hired to replace him, the filing states.
Joseph also alleges that Smith engaged in conduct intended to “groom and prime” him for further sexual exploitation, describing what he characterizes as a pattern of predatory behavior. Smith’s attorney has denied the allegations.
In the complaint, Joseph said he has suffered post-traumatic stress disorder and other mental health issues as a result of his termination.
Joseph is seeking a jury trial, compensatory damages, attorney’s fees, and additional relief to be determined by the court.
The case remains pending, and no court findings have been made regarding the allegations.
