DA Gascón Backs Menendez Brothers’ Bid for Clemency After 35 Years Behind Bars

Los Angeles County District Attorney George Gascón is backing the Menendez brothers’ recent clemency request to California Governor Gavin Newsom, which could lead to a reduced sentence or pardon.

Gascón intends to submit his formal letter of support by the end of Wednesday.

Lyle and Erik Menendez have been incarcerated for nearly 35 years for the 1989 murders of their parents, Jose and Kitty Menendez. In 1996, they were sentenced to two consecutive life terms without parole. Prosecutors argued at the time that the motive was financial gain, while the defense contended that the brothers acted in self-defense after enduring years of sexual abuse by their father.

In addition to the clemency request, the brothers have two other potential paths to freedom. One option is through resentencing, as Gascón recently recommended that their life-without-parole sentence be changed to 50 years to life for murder, removing the “no parole” stipulation.
