US Supreme Court Accidentally Leaks Major Opinion on Idaho’s Abortion Ban

The US Supreme Court inadvertently leaked a significant opinion on abortion rights, indicating a readiness to overturn part of Idaho’s near-total abortion ban.

A document briefly published on the court’s website, then quickly removed, revealed that justices plan to rule that Idaho cannot deny emergency abortions to women whose health is in danger. The court clarified that the opinion, initially obtained by Bloomberg, was “inadvertently and briefly” published and that its final decision has “not been released” but will be presented in due course.

This incident occurs two years after the court’s decision to overturn the national right to abortion access established by Roe v Wade. Since that landmark ruling, various states have enacted a patchwork of abortion laws, with more conservative states like Idaho imposing strict restrictions.

Idaho is among 14 states that ban abortion at all stages of pregnancy, with very limited exceptions. The state has defended its ban, asserting that it allows abortions to save a patient’s life and is not legally required to broaden those exceptions. State attorneys argue that the law does not conflict with federal law.

The leaked opinion, published in full by Bloomberg, suggested a 6-3 ruling that the Supreme Court should not have intervened in the case so swiftly. Conservative Justices Amy Coney Barrett, John Roberts, and Brett Kavanaugh wrote that the court’s involvement was premature as positions on the matter are “still evolving.”

The report indicated that the court would reinstate an order allowing Idaho hospitals to perform emergency abortions to protect patients’ health. If this holds true, the case will proceed to a federal appeals court.
