Harvey Weinstein is scheduled to appear in court on Thursday in Lower Manhattan, but his attendance is uncertain after undergoing emergency heart surgery on Monday. On Sunday, the 72-year-old was transferred from Rikers Island to Bellevue Hospital for treatment of severe medical conditions.
Since his return to Rikers Island from state prison in April—following an appeals court’s decision to overturn his 2020 rape and sexual assault convictions and order a new trial—Weinstein has been in and out of Bellevue Hospital. In July, he was hospitalized for various health issues, including COVID-19 and pneumonia in both lungs, according to his representatives.
The state’s Court of Appeals found that the judge in Weinstein’s 2020 trial had improperly allowed testimony from women whose allegations were not part of the original case.
Last week, prosecutors revealed they are taking steps to potentially charge Weinstein with up to three additional sexual assaults. They have begun presenting evidence to a grand jury regarding two alleged sexual assaults in the mid-2000s and another in 2016. A vote on a potential new indictment is expected soon.
Meanwhile, British prosecutors announced last week that they are dropping two charges of indecent assault against Weinstein from 2022, citing “no longer a realistic prospect of conviction.”
