DSS Seeks N5.5 Billion in Damages from SERAP for Defamation Claims

The Department of State Services (DSS) has initiated a lawsuit against the Socio-Economic Rights and Accountability Project (SERAP), demanding N5.5 billion in damages for allegedly false claims that have tarnished its reputation.

SERAP previously accused DSS agents of unlawfully occupying its Abuja office and demanding to meet the organization’s directors. This incident followed SERAP’s appeal to President Bola Tinubu to direct the Nigerian National Petroleum Company (NNPC) to reverse the recent petrol price increase and its request for the DSS to cease its alleged harassment of Nigerians.

While the DSS confirmed its visit to the SERAP office, it insisted that it was part of a routine investigation and characterized SERAP’s allegations as “malicious,” reaffirming its commitment to professionalism in its operations.

In its lawsuit filed on October 17, the DSS argued that SERAP’s accusations had adversely affected its reputation and that of two officers involved, Sarah John and Gabriel Ogundele. The suit, designated CV/4547/2024, names SERAP and its deputy director, Kolawole Oluwadare, as defendants.

The DSS explained that its visit was in line with its policy to engage with non-governmental organizations (NGOs) in the Federal Capital Territory (FCT) to foster good relations. During the visit, a SERAP staff member reportedly stated that no management officials were available and advised that a formal invitation letter should be sent.

Expressing surprise at the ensuing allegations, the DSS has requested the court to grant several remedies, including:

– N5 billion in damages for the alleged defamatory statements.

– Interest on the claimed amount at 10 percent per annum from the date of judgment until fully paid.

– Coverage of N50 million in legal costs.

– A public apology via SERAP’s website and X handle, along with publication in two national newspapers (Punch and Vanguard) and two television stations (Arise Television and Channels Television).

A hearing date for the case has not yet been set.
