Appeal Court Revokes Arrest Warrant For Rotimi Amaechi With Two Others

An Appeal Court in Port Harcourt, the capital of Rivers State, has reversed a previous bench warrant of arrest issued against Rotimi Amaechi and two others.
Tonye Cole, the All Progressives Congress (APC) candidate in the 2023 elections, and Austine Wokocha, Amaechi’s Commissioner for Power, were also listed in the original warrant.
The revised court ruling came in response to Amaechi and his co-defendants’ appeal, which sought to overturn the lower court’s order.
A panel of three judges heard the appeal, and a majority of two decided to overturn the order. The remaining judge was not satisfied with the outcome.
Justice Abdul-azeez Waziri, who delivered the ruling prepared by Court Presiding Judge Joseph Ikyegh, said the lower court’s order was a defiance of the Court of Appeal.
He revealed that the arrest warrant was issued while Amaechi already had a challenge to the service of information, under Section 313 of the Administration of Criminal Justice Law in the state, lodged with the Appeal Court.
Achinike Wobodo, Amaechi’s lawyer, responded to the verdict, emphasizing that the lower court should have followed the court hierarchy in the nation’s judicial system.
The state government’s counsel, Alphansus Sibi, accepted the Appeal Court’s ruling in good faith.
The arrest warrant was issued last month by a Port Harcourt High Court in connection with a criminal prosecution launched by the Rivers State Government.
The dispute centers on the Amaechi administration’s transfer of public assets, including the state’s gas turbines, to Sahara Energy, a company owned by businessman-turned-politician Cole.
